Terms of Service

These Terms of Service ("Terms") govern your access to and use of the TrainerX coaching workflow platform, websites, and related services (the "Service") provided by TrainerX ("TrainerX", "we", "us", or "our"). Please read them carefully.

Acceptance & eligibility

By creating an account or using the Service, you agree to these Terms. You must be at least 18 years old and able to form a binding contract. If you use the Service on behalf of an organization, you represent that you are authorized to accept these Terms on its behalf.

The Service

TrainerX is a business tool that helps coaches triage their roster and act on connected wearable data. It surfaces insights and workflow actions; it does not provide medical, diagnostic, or treatment services (see "Not medical advice" below).

Accounts & security

You are responsible for providing accurate registration information, keeping your credentials secure, and for all activity that occurs under your account. Notify us promptly of any unauthorized use.

Athlete data & consent

You are responsible for the athletes you invite and connect. Before connecting an athlete's data, you must have the right to do so and must obtain that athlete's informed consent for their health and biometric data to be accessed and processed through the Service. You must respect an athlete's decision to disconnect a provider or leave a coaching relationship. Disconnecting a provider or leaving a coach does not permanently delete an athlete account. During the managed beta, athletes may request permanent deletion directly from TrainerX at privacy@trainerx.io.

Subscriptions, billing & cancellation

Paid plans (such as Growth and Pro) are billed in advance on a recurring monthly basis and renew automatically until cancelled. You can cancel at any time; cancellation takes effect at the end of the current billing period, and fees already paid are non-refundable except where required by law. We may change pricing with reasonable advance notice that applies to your next billing cycle.

Acceptable use

Use the Service only for lawful coaching purposes. You agree not to misuse it, including by reverse engineering, scraping, overloading or interfering with the Service, attempting unauthorized access, infringing others' rights, or using it in violation of the terms of any connected integration.

Third-party integrations

The Service connects to third-party providers such as WHOOP and Apple Health. Your use of those services is governed by their own terms and policies. We are not responsible for third-party services and do not guarantee their availability or continued compatibility.

Intellectual property

TrainerX and its software, content, and trademarks are owned by us or our licensors. We grant you a limited, non-exclusive, non-transferable right to use the Service per these Terms. Your data remains yours; you grant us the rights needed to operate the Service and deliver it to you.

Not medical advice

TrainerX is not a medical device and does not provide medical advice, diagnosis, or treatment. Insights and scores are provided to support, not replace, the professional judgment of a qualified coach or clinician. Do not rely on the Service for medical decisions; consult a qualified professional for health concerns.

Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that insights will be accurate or complete.

Limitation of liability

To the maximum extent permitted by law, TrainerX will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill. Our total liability for any claim relating to the Service will not exceed the amount you paid us in the twelve months before the event giving rise to the claim.

Indemnification

You agree to indemnify and hold TrainerX harmless from claims arising out of your use of the Service, your content, your athletes' data, or your violation of these Terms or applicable law, including the failure to obtain required athlete consent.

Termination

You may stop using the Service and cancel at any time. We may suspend or terminate access if you breach these Terms or to protect the Service. Provisions that by their nature should survive termination (such as IP, disclaimers, and limitation of liability) will survive.

Governing law & disputes

These Terms are governed by the laws of the jurisdiction in which TrainerX is established, without regard to conflict-of-law rules. We encourage you to contact us first to resolve any dispute informally.

Changes to these Terms

We may update these Terms from time to time. Material changes will be posted here with a new "Last updated" date, and your continued use of the Service after they take effect constitutes acceptance.
